KC Conservatory Guide

The information we need

This guide is used by ourselves during our initial visit. It ensures that the conservatory ordered is exactly the one required, and requested by you, the customer. It is reproduced here to give you an understanding of the process.

Stage 2: Planning Permission

The following is an indication as to planning permission requirements. These can vary from area to area, but in the main hold good for England, Wales and Northern Ireland. Scotland may require additional information. Current Town and Country Planning Act defines a conservatory as a Home Extension.

Generally, planning permission is not required to erect a conservatory subject to certain regulations:

That the conservatory does not increase the overall volume of the original home by whichever is the greater of the following provisos:

  • Detached and semi detached properties of 70 cubic metres or 15% of the original dwelling up to a maximum of 115 cubic metres.
  • Terraced or town houses of 50 cubic metres or 10% of the original dwelling up to a maximum of 115 cubic metres.

The conservatory must not:

  • Project further than the existing wall of the house facing the road.
  • Be higher than the highest point of the dwelling.
  • Be within 2 metres of a boundary wall, its height must be no greater than 4 metres.
  • Cover an area of 50% of the original garden area.
  • Be used as an independent dwelling place.
  • Be a listed building or in a conservation area.

 

Building Regulations

Generally conservatories are exempt from Building Regulation approval provided the floor area does not exceed 30m squared but Local Authority rulings do affect the permeable area occasionally.

Regulation B4 requires external walls and roofs of a building to resist the spread of fire from one building to another with regard to height, use and position of the building. The requirements of B4 will be met:

  • if external walls restrict the risk of ignition from external source and spread of fire over their surfaces.
  • if the amount of unprotected area is restricted to limit thermal radiation passing through the wall.
  • if the roof is constructed to limit the spread of flame and fire penetration.

Glazing must also satisfy the requirements of Regulation N1 which requires glazing with which people are likely to come into contact should:

  • be of a type that if broken is unlikely to cause injury, or;
  • resist impact without breaking, or;
  • be shielded or protected from impact.
